DATA PROTECTION REGULATIONS AND LEGAL INFORMATION


PRIVACY POLICY

The following information relates to various websites that are the responsibility of WM SE and to other situations in which WM SE comes into contact with customers, partners and interested parties. Not all of the points listed below apply to each of these situations. However, for reasons of simplification (reduction of administrative adjustments), the situations are generally displayed in full, even if they do not apply in individual cases (e.g. data requiring consent is not collected on every website).

WM SE (hereinafter "WM SE", "we" or "us") respects and protects your right to data protection and privacy. The privacy policy describes

  • the data that we collect via our websites (public and closed areas)
  • Data that you provide to us as a customer or partner.
  • Data about our customers' purchases.
  • The rights you have in relation to your personal data and how you can assert these rights.

"Personal data" is data that makes you personally identifiable in a direct or indirect way, e.g. name, e-mail address and purchased items (insofar as we can assign these to your e-mail address / customer account).

WHEN WE COLLECT PERSONAL DATA

We obtain personal data from or about you depending on your activities, but in particular in the following cases:

Via our website:

Request a call back: we store your name and telephone number when you ask us to call you back.

Contact: If you ask us to contact you, we will store your company, title, surname and first name, telephone number, e-mail address, address and zip code so that we can provide you with expert advice through one of our local sales outlets.

Price inquiries: For price inquiries, we store your company and customer number as well as your title, first name and surname, telephone number, e-mail address and the content of your inquiry.

Customer acceptance: As a new customer of WM SE, we store at least your surname and first name, your address and your e-mail address. We also store voluntarily submitted data such as title, company, company form, telephone and fax.

Newsletter: As a customer, you can subscribe to our newsletter. For this purpose, we store your e-mail address and your customer number.

Visits to our website / e-mail traffic:
We store data on your visits to our website (pages visited, information on the browser used, your IP address) and on interactive e-mail traffic between WM SE and you. Further information on this can be found in the Cookies section.

Workshops that have concluded partner agreements with us can create their own websites using our modular system. The workshops are responsible for their content. The modular system offers a maximum of options for contacting you by e-mail (storage of your e-mail address) or filling out a contact form (name, address, telephone, e-mail, request).

When using other services for workshops on our website (e.g. job portal), different data (depending on the service offered) is forwarded directly to the workshops. In these cases, too, the workshops are responsible for collecting the data.

Job vacancies: We publish job vacancies on our website. Once we have received an application for a job vacancy, you will receive a confirmation of receipt. If you are hired, the application documents will be filed in the employee file. In the event of a rejection, we keep the application documents for a further 6 months due to legal regulations before we delete them from our systems.

About external websites:

Job vacancies: We publish job vacancies via specialized portals. Your applications for our job advertisements are forwarded to us by the portal operators. In these cases, the portal operators are responsible for compliance with data protection regulations with regard to the collection and transmission of data to us. Once we have received an application for a job vacancy, you will receive a confirmation of receipt. If you are hired, the application documents will be filed in the employee file. In the event of a rejection, we will retain the application documents for a further 6 months in accordance with statutory regulations before deleting them from our systems.

Via separate contracts:

Partner agreements: For customers who conclude partner agreements for our workshop concepts, we store the contact details, internet address and company owner in addition to the customer number and company. The same applies to partners from whom we purchase services and/or products.

Bosch hotline: If you as a customer conclude a contract with us for the use of the Bosch hotline, we store your company and your full contact details (address, telephone and fax number, e-mail address) and the diagnostic device(s) used. The name, function and telephone numbers of the authorized users of the hotline are also stored.

About purchases:

Transactions:
We collect data from customers about purchases (online, in stores, over the phone, ...). In addition, we collect data from communication with you in the event of returns, exchanges or sending in products in connection with warranty claims or repair services. 

Granting of discounts:
Cash sales where we grant discounts are subject to special statutory regulations. In these cases, the identity of the purchaser must be established beyond doubt. We therefore collect your identity card data once for these purchases and have this checked by other employees. Following the check, but after 4 weeks at the latest, the ID card data is deleted again.

About marketing campaigns:

Participation in prize draws, competitions or promotions:
We store your company, your name and your contact details if you take part in prize draws, competitions or promotions organized by us.

Partner events and trade fairs:
If you participate in our partner events or trade fairs, we store at least your company and first name(s) or surname(s) of the visitor(s). If necessary, we also store ID card numbers and dates of birth (e.g. when traveling abroad).

HOW WE USE PERSONAL DATA

Transactions / provision of services:

Transactions:
We use your personal information to process your purchases, send confirmations, review transactions for fraudulent activity, process returns, process repairs and exchanges of products, respond to customer inquiries, and for all related communications. 

Legal requirements:
Legal requirements, for example from copyright law, the tax code, labor law, the Equal Opportunities Act or criminal law, sometimes specify different retention periods for certain personal data. We use your personal data to comply with these requirements.

Administration of the websites:
We use your personal data to manage your account on our website and to present the offers from the workshop concepts you have selected. We also use your personal data to provide other services, such as processing catalog requests, sending the newsletter or offering promotions, and to verify your identity in case you have forgotten your password.

Sweepstakes or competitions:
If you choose to participate in a sweepstakes, contest or competition organized by us, we will process your personal data to enable you to participate.

Safeguarding our assets:
We may use personal data for measures to ensure the security and integrity of our websites and our business.

We may collect and use personal data in connection with any of the above purposes.

Data analysis:
With your consent, we may store data about your visits to our website, including details of the pages visited and services used, as well as data about your electronic interaction with emails we send to you as "usage data". This data is not stored under your name, but anonymized using an ID number. We use such usage data to obtain information about the shopping preferences of our users, to adapt our offers and websites to your interests and preferences, to resolve problems with websites, products and services and to optimize them, to analyze trends and statistics and to present our content in the most appealing and user-friendly form for you. 

You can revoke the use of your personal data for data analysis at any time. To do so, please send an e-mail to datenschutz@wm.de.

USE OF PERSONAL DATA FOR MARKETING PURPOSES:

We may use personal data for marketing and market research purposes in order to gain information about our customers and users and for direct marketing. We will always contact you for marketing purposes in accordance with the applicable legal provisions. This means in detail: 

We may send you letters unless you have expressly objected to receiving them.

We may send you e-mails with information on products that are comparable to products you have already purchased, provided you have not objected to receiving such e-mails.

Any further contact for direct marketing purposes (e.g. further e-mails, SMS messages) will only be made with your express consent. If we send you marketing materials, we will only use them to advertise our own products.

We publish information on events (e.g. trade fairs, customer events, etc.) on various platforms. These can be picture galleries on the Internet, trade fair homepages for the press or even You-Tube contributions. You can object to the use of your data and photos on site with the organizer of the event (e.g. the customer information service). Information on the right to object will also be displayed at the respective event venues.

You can object to the use of your personal data for marketing and market research purposes or for direct marketing at any time. To do so, please send an e-mail to datenschutz@wm.de.

COOKIES AND OTHER TECHNOLOGIES

We use cookies and other technologies such as pixel tags. Cookies allow us, for example, to customize a website to your interests or to save your password so that you do not have to re-enter it each time.

DISCLOSURE AND SHARING OF PERSONAL DATA

We may disclose or share your information with other companies in order to fulfill the tasks and purposes set out in this Policy. These companies may be WM SE companies or external third parties that may also be located outside of your country of residence. These third parties provide various services such as our workshop concepts, the processing of payments via various channels or the realization of our marketing campaigns and trade fair appearances. In order to provide such services, it is necessary for us to pass on your personal data to the companies involved.

According to the authorization concept, for example, sales of Bosch parts by customers of Bosch Car Service, Auto Crew or Bosch module partners must be reported to Bosch every six months. For the preparation of trade fair appearances, it is necessary to pass on company names and contact details of exhibitors to the trade fair company and coordinators. Other examples of such services are credit checks and support and maintenance of our IT infrastructure.

Where we engage external service providers to work with personal data on our behalf, we will take appropriate and reasonably practicable steps to contractually ensure that your personal data is only used for the purposes we specify.

We may disclose your personal data where necessary to comply with legal requirements, legal requests from public authorities, including to meet national security or law enforcement requirements, to protect and defend our company, including our subsidiaries, and our officers, employees, legal advisors, agents, contractors and partners, to take legal action or proceedings, to enforce legal claims, or to ensure the implementation of our terms and conditions of use and sale and the contracts we enter into.

We may disclose your personal data to third parties if all or part of our assets are transferred to third parties. This is on the condition that these third parties have data protection provisions in place that are comparable to the data protection provisions set out in this document and that, where necessary, you have given your consent to this step. On certain websites, we allow you to share personal data with third parties, such as partner companies and workshops. Where you use such functions, you agree to the data transfer. The data protection provisions of the third parties apply to the transferred data. We have no influence on how such third parties use your personal data and accept no responsibility for the use of data by third parties. Please inform yourself about the respective data protection provisions of third parties and about the type and scope of use of personal data by them. 

We may share aggregated, non-personal information about website users without restriction.

RETENTION PERIODS

The retention periods for your personal data are based on the applicable legal provisions and the retention period required to fulfill the tasks and purposes stated in this document.

Your personal data will be deleted after expiry of the statutory or required retention period. We cannot delete your personal data if there is a legal obligation to retain it (e.g. accounting regulations) or if there are other legal reasons for not deleting it, such as contractual obligations.

SECURITY

The security of your personal data is important to us. We are aware that no data protection and security standards or measures can guarantee one hundred percent security. However, we will take all steps reasonably necessary to ensure that the data you provide to us is treated securely and in accordance with this policy. We take various precautions to protect data from loss, misuse, unauthorized access, unauthorized recording, use, disclosure, copying, modification, alteration, destruction and similar risks.

LINKS TO OTHER WEBSITES

Whenever we provide links to other websites on our website, this is done in the interest of our users or as a courtesy to the third-party provider. Sites to which we link and sites that link to our website are not generally under our control. In such cases, we are neither responsible for the content of these sites nor for compliance with the applicable data protection regulations. We recommend that you carefully read the respective data protection notices of these third-party providers to find out how your personal data is stored, used or shared.

OBJECTION AND REVOCATION

In relation to the personal data that you have provided to us or that has been collected under this Privacy Policy, you may opt out of the use of your personal data for direct marketing purposes about our products and promotions. You can contact us at any time about the various opt-out options, see also "Contact". The option to object does not apply to any communication that does not serve marketing purposes. You have the option of withdrawing your previously given consent (e.g. newsletter) at any time.

If you do not object to the use of your data for direct marketing purposes directly when you register, it may take up to 30 days for your objection/unsubscription to take effect. The same applies to the revocation of a given consent.

ACCESS TO YOUR PERSONAL DATA AND YOUR RIGHTS IN RELATION TO IT

If they have an account with access to our website, customers can view and change their personal data for this account after logging in to the customer area under the "Change password" button.

We recommend that you contact us directly via the contact address given below under the heading "Data protection" in order to view and safeguard your rights with regard to changes, deletion and restriction for all other data stored by us.

If, in direct contact with WM SE, you feel that your personal data and your rights with regard to this data are not sufficiently protected, you have the right to contact the competent supervisory authority.

This Privacy Policy was posted here on 09.05.2018 and last updated on 15.02.2024. Any future changes to this Privacy Policy will be posted on this page. If necessary, you will also receive a notification by email.
